Medical Negligence

Claiming Compensation

If you have received treatment which has resulted in injury within the last 3 years, you may be entitled to claim compensation. You are only entitled to claim compensation up to 3 years from the date of your treatment or from the date you become aware you have suffered a loss.

We all respect the work medical staff do to take care of us. However, sometimes things do not go as planned. When that happens sometimes we are left worse of and may never completely heal. The injuries you sustain may be with you for the rest of your life or may seriously hinder your quality of life. It is at times like these that you need a solicitor in your corner to obtain you compensation to try and put in you in the position you were in prior to the negligence.

When can I claim compensation?

You can claim compensation if you have suffered negligence at the hands of a medical professional or institution.

What injuries can I claim for?

You can claim compensation for any physical injuries and may be entitled to claim compensation for any psychological injury.

How do I prove if the treatment I received was negligent?

The leading case in this area is Hunter v Hanley. In order to prove that your treatment was negligent we require to prove the following:

  1. That there is a normal practice or procedure;
  2. That this normal practice of procedure was not followed by the medical professional; and,
  3. That what was done no ordinary medical professional with reasonable skill and knowledge would have done.

However, we wouldn’t want you to bother about this too much. This is what we are here for!

What else can I claim for?

You can claim compensation for a number of other things including, any loss of income or remedial treatment.

How much will it cost me?

NOTHING! We pursue all of our claims on a ‘no win no fee’ basis which means you don’t pay a penny if you are not successful.

How much compensation will I receive?

The amount of compensation you receive is wholly dependent on what your injuries are and how long they take to resolve. As a result, it will not be possible for us to give you an estimate as to how much your claim will settle for until we are in receipt of all your losses and medical reports.
