Making a Personal Injury Claim

When it comes to making a personal injury claim in Scotland, you must be able to establish three things:

  1. That you have suffered an injury or a loss
  2. That someone else (either an individual or an organisation) was to blame
  3. That the person or organisation at fault had a duty of care, meaning they were responsible for your safety and failed to take the necessary steps to protect you

Many people suffer in silence after an accident, believing they don’t have a claim or that they are simply the victim of bad luck. Personal injury law aims to restore you to the position you would have been in had the accident never occurred. Our solicitors have a proven track record of achieving the best possible outcomes for clients across Glasgow and Scotland.

Obviously, this isn’t always possible. If your accident caused life-changing injuries, compensation is designed to help ease your pain, suffering and loss of quality of life.

When it comes to accidents at work, some people can be reluctant to make a claim against an employer. However, any claim is directed at your employer’s insurer, who are in place for exactly this purpose.

One major claims management company in the UK estimates that up to £1.4 billion in personal injury compensation goes unclaimed every year, with as many as half of people injured in an accident that was not their fault failing to make a claim. If you are injured as a result of someone else’s negligence, compensation is not a “nice to have” — it is your legal right.

If you’d like to make a claim, contact our team on 0141 378 0514, or fill out our enquiry form, and a member of our team will be in touch.

Scotland's Three-Year Time Limit

In Scotland, you generally have three years from the date of your accident to make a personal injury claim. This is known as the timebar. There are limited exceptions (for example, in industrial disease claims the three years runs from the date of diagnosis rather than the date of exposure) but it is important to seek legal advice as early as possible to protect your right to claim.

Our Personal Injury Claim Process

Step 1

Contact Khan Law by phone or through our online enquiry form. One of our personal injury solicitors will listen carefully to the details of your accident, gather the necessary information and advise you on whether your claim is likely to succeed.

Step 2

We will investigate the circumstances of your claim, gathering evidence to establish liability. This may include medical reports, witness statements, photographs and any other relevant documentation that supports your case.

Step 3

A report will be prepared by an independent medical expert detailing the injuries you have sustained. We use this report to accurately value your claim and ensure all of your losses are fully accounted for.

Step 4

We will negotiate a settlement with the at-fault party’s insurers. Throughout the process we will provide you with clear, professional advice on any offers received to ensure you achieve the best possible outcome.

Step 5

Once a settlement has been agreed, you will receive your compensation promptly. At Khan Law, there are no hidden fees and everything is explained clearly from the outset.

Frequently Asked Questions - Personal Injury

How does personal injury law work?

Personal injury law in Scotland is based on ‘negligence’, and this can take many forms. A fellow road user can be ‘negligent’ by bumping into you at a red light, or an employer can be ‘negligent’ by failing to provide adequate, working safety equipment.

Even if you are partly to blame you can still make a claim. If you are partly at fault, the law simply reduces your compensation proportionally. So, if you and your employer are both 50% to blame, your award is reduced by half..

Compensation can be claimed for financial loss such as medical expenses and lost income (past and future), for pain and suffering, damage to property and more, depending on the nature and severity of the injury.

It’s highly recommended that you speak to a personal injury lawyer about your specific case – especially before you accept an offer of compensation. Compensation is ordinarily paid by insurance companies who will look to keep costs down. As such, you may be offered an amount which is below the sum you are legally entitled to – and such an offer may not take into account all of your losses.

Our expert personal injury solicitors will guide you through the process of making your claim including establishing and assessing ALL of your losses, establishing liability and negotiating your settlement.

Many people don’t realise that you are able to claim for ALL losses resulting from the injury. For example, you may require medical treatment or physiotherapy, you may incur excess travel costs, you may need the assistance of a loved one (who loses income as a result), or you may need ongoing care. All of these expenses and losses should be included in the compensation you receive.

With personal injury claims, there are time limits.

After an accident, injury or diagnosis, the last thing on your mind may be making a personal injury claim – this is why the law gives you three years from the date of the accident to claim, and longer in certain special situations (3 years from the date of diagnosis in industrial disease claims, for example).

When you are ready, Khan Law’s expert personal injury solicitors are here to guide you through the process. From our initial consultation through to settlement, we are by your side throughout the entire process.

The length of time a personal injury claim takes can vary greatly. Straightforward claims where liability is not in doubt may be resolved reasonably quickly, whereas complicated cases (such as serious medical negligence) can take many months or even years to resolve.

Our expert personal injury lawyers will advise you roughly how long they expect the case to take to resolve and, rest assured, will fight on your side to ensure the process is as swift as possible.

At some stage, the question of the amount of compensation you are entitled to will enter your mind. This is known as the “quantum of damages”, in legal terminology.

The amount of compensation awarded isn’t arbitrary – there are pre-determined amounts set by the law for each type of injury or disease.

The amount you receive is based on several factors including the severity of the injury or diagnosis, the duration of your symptoms, the recovery time, the impact on your work and life and the psychological impact on you. The best personal injury lawyers will leave no stone unturned to maximise the amount you receive – from medical reports, to expert witnesses to detailed accounting of any financial losses, our personal injury solicitors at Khan Law will work hard to ensure that you are awarded the amount of compensation you deserve.

At Khan Law, we offer a no win no fee service for personal injury claims. This means that if your case is unsuccessful, you pay nothing. For many people, compensation claims come from a sense of justice and a desire to right a wrong. Some people wish to prevent similar events happening to others in the future. For others, financial compensation is necessary to help them recover, overcome and adapt to their injuries. There is no right or wrong answer – the law on negligence, personal injury and compensation is clear and exists for a reason. We are here to put it into practice for you.
