Can I make a head injury claim?
If you have suffered a head injury and it wasn’t your fault, we can help you claim compensation.
Whether the injury was caused by a workplace accident, slip or fall, medical negligence, road traffic accident or as a result of being struck by a falling object, we can advise on your prospects for success and how much compensation you may be entitled to receive.
Our expert personal injury lawyers advise dozens of people every year on claiming compensation for head injuries of all types – from cuts and bruises through to more serious injuries such as concussion and fractured skulls.
Head injuries can have profound and long-lasting consequences – even seemingly innocuous injuries can cause ongoing effects such as headaches, vision problems and dizziness or even psychiatric problems. More serious injuries can have life-changing consequences that require ongoing care. The amount of compensation you are entitled to depends on the seriousness and significance of the injury. Our expert personal injury solicitors will advise you on how much compensation you can expect, negotiate with the other party and work hard to secure the maximum amount of compensation for you.

How much can I claim for a head injury?
With head injuries, the severity and impact can range so widely, it’s very difficult to put a precise figure on how much you may receive. The more severe the injury and the consequences, the higher the compensation. Our personal injury lawyers will fight to ensure you receive maximum compensation for your injuries.
Compensation is calculated by taking into account:
- Pain and Suffering
- Financial Loss
- Future expenses and losses
The most serious head injuries can have life-altering consequences and as such, attract significant compensation.
Our team have years of experience in helping clients claim compensation and are here to guide you through the process, including advising you on how much compensation you may be able to claim.

Making a Head Injury Claim
The first step to securing compensation is getting in touch – you can call us on 0141 378 0514 or request a call back. One of our personal injury solicitors will discuss your claim with and let you know if we think you have a valid claim. We’ll guide you through the process and, if necessary, put you in touch with a medical expert to assess the extent of your injury and the impact it is likely to have on you.
We’ll also advise you on how much we think you might be entitled to and put you in touch with specialists who can provide treatment and rehabilitation for your injuries to ensure you have the best quality care and support.
How long do I have to claim for a head injury?
In most cases, you have 3 years from the date of the injury to claim compensation for a head injury. There are, however, some exceptions to this rule.
Lack of capacity – of the injury was so severe that you were unable to seek legal advice then the time limit can be extended.
Children under 16 – if the person injured was a child at the time of the injury, they have until they turn 19 to claim compensation, regardless of when they were injured.
We recommend contacting us as soon as you can – the earlier you contact us, the more likely we are to be able to support you through the process. We don’t just focus on compensation, we will help you access the best medical experts to speed your recovery.
Scotland’s Three-Year Time Limit
You are only entitled to claim compensation up to 3 years from the date of your accident (or 16th Birthday if you were a minor at the time), after this date you will no longer be able to claim.

Frequently Asked Questions - Head Injury Claims
How long does a head injury claim take?
Every claim is different. Some settle within a few months, others may take over a year—especially if the injury is severe or ongoing medical evidence is required.
Can I claim if I was partly at fault?
Yes. You may still be entitled to compensation, although it could be reduced to reflect your share of responsibility.
What if I didn’t go to hospital at the time?
You may still have a valid claim. Medical evidence will still be important, and we can arrange for a specialist assessment.
Will I have to go to court?
Most claims settle out of court, but if necessary, we are fully prepared to represent you in the Sheriff Court or Court of Session.
